Terms of Use

These Terms of Use (“Terms”) govern your use of the mobile game MUTALIX (the “Game”), developed and published by Hafenente, a sole proprietorship registered to Swen Grünwald, Grindelallee 110, 20146 Hamburg, Germany (“we”, “us”). By downloading or using the Game you agree to these Terms. If you do not agree, do not use the Game.

Section 01

License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Game on devices you own or control, for your own personal, non-commercial entertainment. Your use of the Game via the App Store is also subject to Apple’s Media Services Terms and Conditions.

Advertising

The Game is supported by ads unless you purchase “Remove Ads”. Ads are provided via Google AdMob as described in our Privacy Policy.

Section 04

Acceptable use

You agree not to: reverse-engineer, modify, or tamper with the Game; cheat, exploit, use bots, or manipulate scores, leaderboards, currency, or purchases; or use the Game unlawfully or in a way that harms other users or us.

Section 05

Intellectual property

The Game and all its content (code, art, audio, trademarks) are owned by us or our licensors and are protected by law. These Terms grant you no rights other than the limited license above.

Section 06

Availability & changes

We may update, change, or discontinue the Game (or any feature, including online services such as cloud save and leaderboards) at any time. We may update these Terms; material changes are reflected by the “Last updated” date, and continued use after changes constitutes acceptance.

Section 07

Disclaimers & limitation of liability

The Game is provided “as is” and “as available” without warranties of any kind to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (including for intent, gross negligence, or injury to life, body, or health, and liability under mandatory product-liability or consumer-protection law). Subject to that, we are not liable for indirect or consequential damages or for loss of data or progress.

Section 08

Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rights of the country where you reside remain unaffected.
